Terms & Conditions of Sale

These Terms and Conditions ("Terms") apply to every quote, order, sale, supply, and installation of goods and services by Fantastic Blinds ("we", "us", "our") to you ("Customer", "you"). By accepting a quote, paying a deposit, or placing an order, you accept these Terms in full. These Terms prevail over any conflicting terms unless we agree otherwise in writing.

1. Quotes

• Written quotes are valid for 30 days from the date issued, unless otherwise stated.
• Quotes are based on information available at the time (including any check-measure) and are subject to change if site conditions, specifications, materials, or quantities change.
• Verbal or indicative pricing is provided as a guide only and is not binding until confirmed in writing.

2. Custom-made goods

All goods supplied by Fantastic Blinds are custom-made to your measurements, specifications, and colour/fabric selections. Because goods are made to order, they cannot be resold and:

• Orders cannot be cancelled, changed, or refunded once manufacture has commenced;
• You are responsible for verifying all measurements, fabric selections, colours, controls, mounting, and specifications on the quote or order confirmation before signing;
• Fabric swatches, images, and product samples are indicative only; natural variation in colour, texture, weave, and grain is not a defect.

3. Measure and site conditions

• If you provide measurements, you accept responsibility for their accuracy. We recommend a professional check-measure.
• Where we perform a measure, we assume site conditions are structurally sound and suitable for installation. Additional works required due to concealed defects, non-standard surfaces, or subsequent building changes are not included and may be charged separately.
• Any material change to windows, openings, or décor after measurement may require a new quote.

4. Deposits, payment, and title

• A non-refundable deposit (typically 50% of the order value, unless otherwise agreed) is required to commence manufacture.
• The balance is payable on or before installation, unless otherwise agreed in writing.
• Accepted payment methods will be shown on your invoice. Card surcharges may apply.
• Title in the goods remains with Fantastic Blinds until payment has been received in full in cleared funds. Risk in the goods passes to you on delivery or installation.
• Overdue accounts may attract interest at 10% per annum and reasonable recovery costs (including debt-collection and legal fees).

5. Lead times, delivery, and installation

• Estimated lead times are indicative only and are not guaranteed. Delays caused by suppliers, freight, weather, site access, or force majeure are outside our control.
• You must provide safe, clear, and unobstructed access on the agreed installation date. Delays or additional visits caused by lack of access, unfinished building works, or last-minute rescheduling may incur additional call-out or storage fees.
• Where goods are collected or dispatched, risk passes to you upon collection or dispatch.

6. Variations and additional works

Any variation to the original quote — including changes to fabric, size, control, mounting, or additional works — must be agreed in writing and may affect price and lead time.

7. Warranty

• Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.
• In addition, we pass on any applicable manufacturer warranties on components (motors, mechanisms, fabrics), subject to the manufacturer's terms.
• Warranty does not cover: normal wear and tear; misuse, neglect, or improper cleaning; damage caused by pets, children, moisture, or accidents; unauthorised modification or repair by third parties; installation by others; or fading, shrinkage, or movement inherent to natural fibres and timber products.
• To claim under warranty, contact us in writing with your invoice details and a description of the issue.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or in connection with the supply of goods or services is limited, at our option, to the repair or replacement of the goods, the re-supply of the services, or the payment of the cost of doing so. We are not liable for any indirect, consequential, or economic loss, including loss of use, loss of profits, or damage to décor, finishes, or property beyond our reasonable control.

9. Child safety

Corded internal window coverings can pose a strangulation risk to young children. We supply products that comply with Australian mandatory safety standards and provide safety devices with each installation. It is your responsibility to keep cords secured and out of reach of children and to comply with the safety instructions provided.

10. Cancellation

• Orders may only be cancelled prior to the commencement of manufacture and must be requested in writing.
• Any costs already incurred (including check-measure fees, design work, ordered materials, and administration fees) will be deducted from any refund.
• Deposits are non-refundable once manufacture has commenced.

11. Indemnity

You indemnify Fantastic Blinds against any loss, damage, or claim arising from incorrect information you provide, unsafe or unsuitable site conditions, or your breach of these Terms.

12. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, industrial action, shipping delays, supplier failures, or government action.

13. Privacy

We handle your personal information in accordance with our Privacy Policy.

14. Governing law

These Terms are governed by the laws of Victoria, Australia. Any dispute is subject to the exclusive jurisdiction of the courts of Victoria.

15. Severance

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
